General Terms and Conditions for TerraRiot

1. Provider and scope

Your contracting party is Olaf Oberbremer, TerraRiot, Mindener Straße 172, 32049 Herford, Germany. You can contact us at info@terra-riot.com or +49 171 9518512. These terms apply to orders for goods placed through terra-riot.com.

2. Orders and conclusion of the contract

The product presentations in the shop are an invitation to place an order. You select the item, size, colour and quantity and add the items to your cart. Before completing your order, you can check and correct the information in the cart and at checkout. By clicking the final button, which clearly indicates your obligation to pay, you place a binding order.

The contract is concluded when we accept your order by email confirmation, dispatch the goods or request payment. If you choose a payment method where payment is triggered directly at checkout (for example PayPal or credit card), the contract is concluded as soon as the payment process is completed. A mere acknowledgement of receipt that does not contain an acceptance statement does not constitute acceptance. The language of the contract is German. The order details are stored and sent by email; you can save or print the confirmation and the applicable terms yourself.

3. Prices and payment

All prices shown are total prices in euros. No VAT is shown under the small-business scheme pursuant to section 19 of the German VAT Act (UStG). Shipping costs may apply and are shown on our shipping page and at checkout before you place your order.

The payment methods available for your order are shown at checkout. Payment is due in accordance with the terms of the payment method selected there.

4. Delivery

Delivery is made to the delivery address provided with the order, in the countries offered at checkout. Shipping costs and delivery times are set out in the shipping policy and the information for the item. Our standard designs are printed after an order is received. This alone does not exclude the right of cancellation.

For consumers, we bear the shipping risk until the goods are handed over, unless the law provides otherwise. If an ordered item is unavailable, we will inform you without delay; your statutory rights remain unaffected.

5. Cancellation

For standard items, consumers have the statutory right of cancellation in accordance with our cancellation policy, which includes a model cancellation form. You can also declare your cancellation electronically using the “Withdraw contract” button on our website; we will confirm receipt by email without delay. Section 9 applies to individually personalised items.

6. Warranty and liability

The statutory warranty rights apply to defects in the goods. Our liability is governed by statutory provisions. These terms do not restrict statutory consumer rights.

7. Ownership and choice of law

The goods remain our property until payment has been made in full. German law applies. For consumers, mandatory protections under the law of their country of habitual residence remain unaffected.

8. Consumer dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

9. Personalised shirts and hoodies

For shirts and hoodies expressly offered as personalised, we create an individual design using suitable images and text provided by the customer. The total price includes the item, design work and printing on both sides and is €55 for a personalised shirt and €79 for a personalised hoodie; shipping of €3.80 per order is additional for deliveries within Germany. For other delivery countries available at checkout, the shipping charges in our shipping policy apply. Printing begins only after the customer has expressly approved the draft. The delivery period within Germany of 5–6 working days begins after this approval and, for payment in advance, no earlier than receipt of payment. For other delivery countries available at checkout, the respective estimated total delivery times in our shipping policy apply after this approval and, for payment in advance, no earlier than receipt of payment. Agreement on the draft takes place before this delivery period.

If images are unsuitable, we will ask for suitable replacements. If the design cannot be produced, we will refund the purchase price. Customers may provide only images and text for which they hold the rights necessary for designing and printing the item. A separate transfer of the graphics file is not included in the offer.

Goods individually made to customer specifications featuring a personal animal design and text are not subject to a statutory right of cancellation under section 312g(2), no. 1 of the German Civil Code (BGB). We do not offer voluntary exchanges if you dislike the item or have selected the wrong size. Statutory warranty rights in the event of defects remain unaffected.
